Terms of Service

Last updated: May 2026. Please read these Terms of Service ("Terms") carefully before installing or using WishPoint. By installing the app, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing WishPoint from the Shopify App Store, you ("Merchant") agree to these Terms on behalf of yourself and any organisation you represent. If you do not agree, do not install or use WishPoint.

2. Description of Service

WishPoint is a Shopify application that provides a customer loyalty and wishlist rewards program. The app allows merchants to configure points-based rewards tied to wishlist goals, earn events, and redemption workflows. Feature availability depends on the plan you subscribe to.

3. Shopify Platform Dependency

WishPoint operates as an extension of the Shopify platform. Your use of WishPoint is also subject to Shopify's Terms of Service and any applicable Shopify Partner policies. We are not affiliated with or endorsed by Shopify Inc. beyond being a listed Shopify partner.

4. Billing and Payment

All billing for paid WishPoint plans is processed through Shopify's built-in billing system. By subscribing to a paid plan, you authorise Shopify to charge the applicable monthly fee to your Shopify account on a recurring basis.

• Fees are billed monthly in advance.
• There are no refunds for partial months except where required by applicable law.
• WishPoint reserves the right to modify plan pricing with at least 30 days' notice to active subscribers.
• During any early-access or promotional period, pricing may differ from standard rates as communicated within the app.

5. Free Plan and Trials

A free plan is available with limited features as described on our pricing page. Free plans do not require a credit card. We reserve the right to modify or discontinue the free plan with reasonable notice to existing free-plan merchants.

6. Acceptable Use

You agree not to use WishPoint to:

• Violate any applicable laws or Shopify policies
• Manipulate points balances or rewards in a fraudulent manner
• Attempt to reverse-engineer, decompile, or extract the source code of the app
• Use the app to send spam, unsolicited communications, or harmful content to customers
• Resell, sublicense, or redistribute WishPoint's features as a standalone product

7. Intellectual Property

WishPoint and all associated code, designs, branding, and documentation are the exclusive intellectual property of the WishPoint team. Installing the app grants you a limited, non-exclusive, non-transferable licence to use WishPoint for your own Shopify store. No ownership rights are transferred.

8. Limitation of Liability

To the fullest extent permitted by applicable law, WishPoint and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue or profits resulting from your use of the app
• Store downtime or performance degradation (note: WishPoint's widget loads asynchronously and does not block page rendering)
• Data loss resulting from Shopify platform outages
• Actions taken by third-party services (e.g., Resend for email, Shopify for billing, Sentry for error monitoring, Chatbase for support chat)

Our total aggregate liability to you shall not exceed the total fees paid by you to WishPoint in the three months preceding the claim.

9. Disclaimer of Warranties

WishPoint is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or free from security vulnerabilities. You use the app at your own risk.

10. Termination

You may terminate your use of WishPoint at any time by uninstalling the app from your Shopify admin. We may suspend or terminate access to WishPoint if you materially breach these Terms and fail to remedy the breach within 14 days of written notice. Upon termination, your right to use the app ceases immediately and data deletion occurs per our Privacy Policy.

11. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify active merchants of material changes via the WishPoint admin dashboard or email. Continued use of the app after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to conflict of law principles. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bulgaria.
